Terms of service
These terms apply when you buy products from himasalt.co.uk. Please read them before placing an order. They should be read alongside our Refund & Returns Policy, Shipping Policy and Privacy Policy.
Nothing in these terms affects your legal rights as a consumer. For information about your rights, contact Citizens Advice.
1. About us
himasalt.co.uk is operated by HIMA Salt Ltd, a company registered in England and Wales (company number 17313481), registered office 3-4 Windmill House 277 Tong Road, Leeds, England, LS12 4NQ.
Contact: sales@himasalt.co.uk
2. Who can buy
- You must be 18 or over to place an order.
- Our website is for consumers buying for their own personal or household use. We may decline or limit orders that appear to be for resale or business use, or that exceed reasonable household quantities.
- Retailers, caterers and other businesses should buy through our wholesale service under our separate Trade Terms. Contact sales@himasalt.co.uk for details.
- We currently deliver to UK addresses only.
3. Placing an order and how the contract is formed
- Add products to your basket and go to checkout, where you can review and correct your order before paying.
- When you pay, you are offering to buy the products.
- We'll email to acknowledge your order. This does not mean your order has been accepted.
- The contract between us is formed when we email to confirm your order has been dispatched.
- If we can't accept your order, for example because a product is out of stock, there was an error in the price or description, or we can't deliver to your address, we'll tell you and refund you in full.
These terms are in English only. We don't keep a copy of the contract for you to access, so please save or print these terms and your order emails.
4. Our products
- Our salt is a natural, unrefined product. Colour, crystal size and appearance vary naturally between and within batches, and images on our website are for illustration. See section 5 of our Refund & Returns Policy for the characteristics that are normal and not faults.
- Our products are for culinary use only. They are not a medicine or food supplement, and nothing on our website is medical or nutritional advice. If you have concerns about your salt intake, please speak to a health professional.
- Store salt in a cool, dry place and reseal after opening.
- We may change product descriptions, packaging or our range at any time. This won't affect orders we have already accepted.
5. Prices and payment
- Prices are in pounds sterling. Our food products are zero-rated for VAT, so no VAT is added.
- Delivery charges are shown at checkout before you pay.
- Pricing errors: if a price on our website is wrong, we'll contact you before dispatch to offer the correct price or a full refund. If the error was obvious and should reasonably have been recognised by you as a mistake, we don't have to supply at the incorrect price, even after acknowledging your order.
- Payment is taken when you place your order through our payment providers. You must be authorised to use the payment method you choose.
6. Discount codes and promotions
- Only one discount code can be used per order unless we say otherwise. Codes have no cash value, can't be exchanged or applied to past orders, and may have their own terms (such as an expiry date or minimum spend). If a promotion's terms conflict with these terms, the promotion's terms apply to that promotion.
- We may withdraw a code or cancel an order where a code was issued in error, has been shared publicly when it was meant for one person, or is being misused.
- If you return part of a discounted order, your refund will reflect the discount actually applied.
7. Delivery
- We'll deliver to the address you give at checkout. Estimated delivery times are shown at checkout and in our Shipping Policy. We'll deliver within 30 days of accepting your order unless we agree otherwise.
- We're not responsible for delays caused by events outside our control (see section 11), but we'll keep you informed and you may cancel and receive a full refund if the delay is significant.
- Delivery is complete, and the products become your responsibility, when they are delivered to your address, left in a safe place you've specified or that is permitted by our courier, or handed to a neighbour or someone at your address.
- If delivery fails because of an incorrect address you gave us, or because a parcel wasn't collected from the courier, we may charge you the cost of re-sending it. Our Refund & Returns Policy explains what happens if a parcel is returned to us.
- Ownership of the products passes to you once we have received full payment and they have been delivered.
8. Cancellations, returns and faulty products
Your rights to cancel and return products, and what to do if something arrives damaged or faulty, are set out in our Refund & Returns Policy. In summary, you can cancel within 14 days of delivery for unopened products. Opened products can't be returned for a change of mind because they are sealed for hygiene reasons. Your rights for faulty products are not affected.
9. Our responsibility to you
- We must supply products that are of satisfactory quality, fit for purpose and as described. If we fail to comply with these terms, we're responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious it would happen, or if both of us knew it might happen when the contract was made.
- We're not responsible for loss or damage that is not foreseeable, or for loss caused by using a product other than as intended (for example storing it in damp conditions).
- We only supply products for domestic and private use. If you use them for any commercial or business purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights, or for defective products under the Consumer Protection Act 1987.
10. Business customers
If you buy from our website in the course of a business despite section 2, the consumer rights described in these terms (including the right to cancel) do not apply. To the extent permitted by law, all implied terms are excluded, we will not be liable for any indirect or consequential loss or any loss of profit, revenue or business, and our total liability to you will not exceed the price you paid for the products concerned.
11. Events outside our control
We're not responsible for delays or failure to perform caused by events outside our reasonable control. These include delays at sea or in customs, supplier or courier failure, strikes, extreme weather and pandemics. If such an event affects your order, we'll contact you as soon as possible. You may cancel and receive a refund for products you've paid for but not received.
12. Reviews and content you submit
- When you post a review, comment or other content on our website or social media, you give us a free, non-exclusive, worldwide licence to use, reproduce and publish it, with your first name or username, in any medium to operate and promote our business.
- Your content must be honest, based on your own genuine experience, lawful, and must not be offensive, defamatory or infringe anyone's rights. If you received anything in return for a review (such as a free product or discount), you must say so in the review.
- We publish genuine reviews whether positive or negative. We don't write or buy fake reviews, and we may remove content that breaches these terms or that we reasonably believe is fake or misleading.
13. Using our website
- You may use our website for personal, non-commercial purposes. All content, including our name, logo, images, text and packaging designs, belongs to us or our licensors. You may not copy or reuse it without our written permission.
- You must not misuse our website. This includes introducing viruses, attempting unauthorised access, or scraping or harvesting content or data. Automated tools and AI agents must identify themselves as such and comply with any restrictions we put in place. We may restrict or block automated access at any time.
- If you create an account, keep your login details confidential. We may suspend or close an account that has been used fraudulently or in breach of these terms.
- We don't guarantee that our website will always be available or error-free, and we may update or suspend it at any time. Links to other websites are provided for information only, and we're not responsible for their content.
14. Shopify
Our online shop is hosted by Shopify. All sales are made directly between you and HIMA Salt Ltd, and Shopify is not a party to them. To the extent permitted by law, you agree that Shopify is not responsible for any aspect of sales between you and us. This does not affect your statutory rights against us.
15. Your personal information
We use your personal information as set out in our Privacy Policy.
16. Complaints
If you have a problem, please contact us at sales@himasalt.co.uk. We aim to acknowledge complaints within 2 working days and resolve them as quickly as possible.
17. Other important terms
- Changes: we may update these terms from time to time. The terms in force when you place your order apply to that order.
- Transfer: we may transfer our rights and obligations under these terms to another organisation. If we do, we'll tell you, and your rights won't be affected. You may only transfer your rights with our written consent.
- Severability: if a court finds any part of these terms unlawful, the rest will continue in force.
- No waiver: if we delay in enforcing these terms, we can still enforce them later.
- Third parties: nobody other than you and us has any right to enforce these terms.
- Law and courts: these terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
